If you do not agree to these terms and conditions of use, please do not use the Site. Except where stated otherwise, the term "miniecigarette.com" used on the Site shall be deemed to include Miniecigarette.com and its affiliates, subsidiaries, successors and assigns. MiniECigarette.com reserves the right, at its discretion, to change, modify, add or remove portions of these terms and conditions at any time. Please check these terms and conditions periodically for changes. Your continued use of the Site following the posting of changes to these terms and conditions will mean you accept those changes.

General disclaimer and limitation of liability.

You expressly agree that use of the site is at your sole risk.

The Site, the services and the information or materials herein are provided on an "as is, where is, as available" basis. MiniECigarette.com makes no representations or warranties, either express or implied, of any kind with respect to the site, its contents (including without limit product descriptions and prices) or the services. MiniECigarette.com disclaims all warranties, express or implied, including, but not limited to, merchantability and fitness for a particular purpose. The user expressly acknowledges that (I) there are no warranties or representations made regarding the content of the site including without limitation how current it is, its accuracy, its completeness, its availability, its security, that defects will be corrected or that the site, any hyperlinked website, or the servers upon which they reside is free of viruses or other harmful components; and (II) as a service to users of the site MiniECigarette.com may include links to other websites that MiniECigarette.com has no control over, and makes no endorsements or representations of any kind regarding the products, services, business practices, content or appropriateness of content on such websites, and the user hereby irrevocably waives any claim against MiniECigarette.com with respect to such websites.

MiniECigarette.com strives at all times to protect the security and privacy of any information you provide over the internet to MiniECigarette.com. However, because of the inherent nature of the Internet, MiniECigarette.com cannot guarantee that this information will not be improperly accessed or used by third parties. Age Limit

You must be at least 18 years old or of legal age within your state to order from MiniECigarette.com. By accepting these terms and conditions you are indicating you are of legal age to purchase the goods. Those found falsifying their age will be prosecuted by the law.

Customs and Import Duties Information for International Customers

We currently do not ship Internationally.

Warranty

MiniECigarette.com offers our customers a 30-day manufacturer's warranty against product defect for the 403 and 502 models and a 60-day warranty for the 510 and eGo models.  If your electronic cigarette is found to be defective within that time frame from original purchase, MiniECigarette will repair or replace it.  If you return your electronic cigarette under warranty and it is found that the cigarette and/or components have been misused or abused, you will be charged for any replacement parts.

We do NOT offer a satisfaction guarantee. 

MiniECigarette's nicotine replacement cartridges will only be replaced if they were damaged in shipment to the customer.  Otherwise, due to the nature of this product, nicotine cartridges cannot be returned.

Electronic Cigarettes come in different lengths and diameters.  If you did not purchase your electronic cigarette through MiniECigarette.com, we cannot guarantee that our nicotine cartridges will fit your electronic cigarettes.

Processing Time

You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. MiniECigarette.com tries to provide, but does not guarantee same day-shipping. Orders are not processed on holidays.

Product Return Procedure

We cannot accept returns on products that have been used.  However, we do accept returns for defective product.

To return a product in compliance with MiniECigarette's warranty, you must contact us, within the warranty period for the product (as described above), prior to shipping your electronic cigarette back to us.  MiniECigarette will not accept returns without prior authorization. You will then have 15 days in which return products must be received by MiniECigarette.

The customer is solely responsible for shipping any returned product to MiniECigarette. The customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. The customer agrees to bear all shipping and insurance charges, and to bear all risk of loss for the return product during shipment. The customer agrees that all returned products will be 100% complete, and will include the original packaging material, manuals, and any other accessories the manufacturer may have provided, other than the nicotine cartridges. If any component of the returned product is missing, damaged/abused or not returned in the same condition as it was when it was originally sent to you, MiniECigarette's Return Procedure will be breached, and MiniECigarette may in its sole and absolute discretion reject the entire return or choose to impose additional charges against the customer for replacement of the missing/damaged component(s).

MiniECigarette will not refund the original shipping charges.

Limitation of Liability

In all circumstances, MiniECigarette's maximum liability is limited to the purchase price of the products sold. MiniECigarette shall not, under any circumstances, be liable upon a claim or action in contract, tort, indemnity or contribution, or other claims relating to any products it sells that exceeds this liability limit. MiniECigarette shall not be liable for third party claims for damages against the customer, or for malfunction, delays, interruption of service, loss of business, loss or damage, or exemplary damages, whether or not MiniECigarette.com has been made aware of the possibility of such claims or damages.

Indemnity

You agree to indemnify, defend and hold harmless MiniECigarette.com, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity (including negligent or wrongful conduct) related to your use of the Site.

Governing Law and Jurisdiction

The Site is controlled by MiniECigarette.com from its office within the State of Michigan, United States. This Site can be accessed from all States in the United States, as well as from other countries around the world. As each of these places has laws that may differ from those of the State of Michigan, United States, by accessing this Site, you agree that all matters relating to access to, or use of, the Site, or any other hyperlinked website, shall be governed exclusively by the laws of the State of Michigan and the laws of the United States applicable to the State of Michigan, without regard to the conflicts of laws and principles thereof. You also agree and hereby submit to the exclusive personal jurisdiction and venue of the courts of the State of Michigan and acknowledge that you do so voluntarily. You are responsible for complying with your own local laws.

General

In the event that any parts of any terms and conditions are held to be indefinite, invalid, illegal or otherwise voidable or unenforceable, the other parts of those terms and conditions will not fail on account thereof, and the balance of the terms and conditions will continue in full force and effect. You may also be subject to other terms and conditions when you access other sites or other portions of the Site (if specified) or if you access or purchase third party content or software. The section titles in these terms and conditions are for convenience only and have no legal or contractual effect.

Entire Agreement

These terms and conditions, together with MiniECigarette's invoice regarding the products ordered by the customer, are the complete and exclusive agreement between MiniECigarette and the customer, and as such they shall supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between MiniECigarette and the customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
